These terms cover your use of builtbyemmett.com (the “site”) and how you and I deal with each other before any project starts. I’m Emmett Green, and I run a one-person web design business under the name Built by Emmett. Built by Emmett is a business name I use, not a separate company. In these terms, “I,” “me” and “my” mean Emmett Green, and “you” means anyone who visits the site or gets in touch with me through it.
The short version
- You’re welcome to browse the site and contact me. Please don’t copy it, break it or misuse it.
- Prices on the site are starting points. You get an exact quote after we talk, and nothing is booked until we both sign a written agreement.
- Project work is governed by that signed agreement. If it ever disagrees with these terms, the agreement wins.
- I do my best to keep the site accurate, but I can’t promise it’s perfect, and I’m not responsible for other websites I link to.
This summary is only a guide. The full terms below are what count.
1. Who these terms are between
By using the site or sending me a message through it, you agree to these terms and confirm you’ve read my privacy policy, which explains how I handle your information. If you don’t agree with them, please don’t use the site.
If you’re contacting me on behalf of a business, you’re confirming that you’re allowed to act for that business. If you’re under 18, you’re welcome to ask questions, but I’ll need a parent or guardian involved before we sign anything, and they’ll sign the project agreement with you.
2. Using the site
You can use the site to learn about my work, check prices and contact me. Please don’t:
- send spam, automated submissions or false information through the quote form;
- try to break into the site, overload it, scrape or copy it with bots (search engines indexing the site is fine), or get around its security and spam filters;
- copy the site’s design, code, text or images to build another site, or pass my work off as your own;
- use the site for anything illegal.
I can block anyone who misuses the site. The site is hosted on Cloudflare, which may challenge or block traffic that looks automated or abusive. I can change, pause or take down the site, or any part of it, at any time.
3. Prices and information on the site
- Starting prices. The prices on the site are starting prices for a typical project of that kind. Your project may cost more depending on what it needs, and the exact price is set in your quote and written agreement, not by the site.
- Prices can change. I can change the prices and plans on the site at any time. A price change doesn’t affect a quote I’ve already sent you while that quote is still good, or a project we’ve already agreed to in writing.
- Comparisons. Where the site compares my prices with other designers or firms, the figures come from the sources named on that page, as of the date shown there. Those figures can change, and they’re there to give you a rough picture, not an exact quote from anyone else.
- Mistakes. I work hard to keep the site accurate, but typos and out-of-date details can slip through. If a price or feature is listed wrong, I’m not bound to it, and I’ll tell you the correct one before we agree to anything.
- Timelines and examples. Build times, loading speeds and other examples on the site come from specific past projects or test builds. They show what is possible, not what your project will get.
4. Quotes and the quote form
- The form. Sending it isn’t a booking. It’s a request for a conversation. I’m not obliged to take on every project, and you’re not committed to anything by asking.
- Replies. I aim to reply within one business day, but I can’t guarantee a response time.
- Quotes are estimates until they’re signed. A quote I give you by phone, text or email is my best estimate based on what you’ve told me. It can change if the project changes, and it only becomes binding once it’s written into a signed agreement. Unless I say otherwise, a quote expires 30 days after I send it. Within those 30 days I’ll honor it as long as the project you described hasn’t changed. After that, ask me and I’ll confirm it or send an updated one.
- What you send me. Please only send information you have the right to share, and nothing confidential until we’ve agreed in writing to keep it that way.
5. Hiring me
Every project runs under a separate written agreement that we both sign before work starts. That agreement covers the scope, price, payment schedule, revisions, timeline, ownership, the care plan and how either of us can end the project. It’s the contract for the work. These terms only cover the site and our contact before a project starts. If anything in these terms conflicts with a signed agreement, the agreement wins for that project.
6. My content and your content
My content
The design, code, text, images, logo and name on this site belong to me or to the people who licensed them to me, and are protected by copyright and trademark law. You can view the site, share links to it, and quote short parts of it to describe my work, for example in a review. You can’t copy or reuse any other part of it without my written permission.
Your content
Anything you send me, like a message, photos or a logo, stays yours. By sending it, you give me permission to use it to reply to you, prepare a quote and, if we work together, do the work. You’re responsible for making sure you have the right to share what you send.
Feedback
If you give me ideas or suggestions about the site or my services, I can use them without owing you anything.
7. Portfolio work
The sites shown in my portfolio belong to the businesses they were built for, or are concept projects I made to show what I can do. They are not real businesses, products or offers. Some concept pages mention real companies only as examples. Those companies have no connection to me and have not approved or endorsed my work, and nothing on a concept page is an offer to sell anything, investment advice, or a statement about any real company. Any numbers on those pages are made up. Client sites are shown with each client’s permission, and what you see is how a site looked when I captured it, which may differ from how it looks today.
8. Other websites and services
The site links to other websites, like client sites, pricing sources and tools I use. I don’t control those sites or services, and I’m not responsible for their content, accuracy, availability or how they handle your information. A link isn’t an endorsement. When you use another site or service, its own terms and privacy policy apply.
9. Texting and email
If you give me a phone number or email address, you agree that I can use it to reply to your request, send a quote and talk about your project. I don’t send marketing texts or newsletters. Reply STOP to any text, or tell me any other way, and I’ll stop contacting you. Standard message and data rates from your carrier may apply to texts. My privacy policy has the details.
10. No guarantees
To the extent the law allows, the site is provided “as is” and “as available.” I do my best to keep it accurate, secure and online, but I can’t promise it will always be, or that it will be free of errors or interruptions. I don’t guarantee search rankings, traffic, sales or any business result from anything described on the site. Everything about a real project, including what I do promise, is set out in the written agreement for that project.
11. Limit of liability
To the fullest extent the law allows, I’m not responsible for any indirect, incidental or consequential loss, such as lost profits, lost data or lost business, that comes from using the site, relying on information on it, or being unable to use it. My total responsibility to you for anything connected to the site is limited to $100. This limit doesn’t apply to project work, which is covered by the limit in the written agreement for that project, and it doesn’t limit any liability the law says I can’t limit, such as liability for fraud, willful misconduct, or personal injury caused by my negligence.
Some states don’t allow certain limits on liability, so parts of this section may not apply to you.
12. Disputes and governing law
If there’s a problem, contact me first and we’ll try to work it out directly. These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any lawsuit about the site or these terms will be filed in the state or federal courts located in Hamilton County, Tennessee, and you agree to those courts’ jurisdiction. If any part of these terms is found unenforceable, the rest still applies. If I don’t enforce a part of these terms right away, I can still enforce it later. I can transfer these terms to a business entity I own or to someone who buys the business. You can’t transfer your rights under these terms to anyone else.
13. Changes to these terms
I may update these terms from time to time. When I do, I’ll change the “Last updated” date at the top of this page, and if a change is significant, I’ll point it out at the top of the page. Changes apply from the date they’re posted. Using the site after that means you accept the updated terms. Changes to these terms never change a signed project agreement.
